General terms and conditions of sale

We inform you that the general conditions of sale, set out below, indicate, in compliance with current consumer protection regulations, the conditions and methods with which to proceed with the online purchase on the IPER BIMBO website, hereinafter referred to as the Seller, of the products of your interest in a safe, easy and convenient way. We therefore invite you to read and accept them in order to proceed with the purchase.

I. SUBJECT

These general conditions of sale govern the sale of products marketed by the Vendor to consumer users and users who act for purposes inherent to the business activity.
These general conditions are effective from the date of acceptance of the same by the customer on the site, which is valid in all respects as acceptance pursuant to art. 1341 of the civil code.
The company reserves the right to modify these general conditions of sale at any time by posting them on the site.
Any contractual or extra-contractual liability of the company for direct or indirect damages to persons and/or things caused by the non-acceptance, even partial, of an order is excluded.

II. PURCHASE METHOD

The purchase of the products takes place through access to the site and the relative registration. For each of the products, a description containing the main characteristics of the same is available on the site. All purchase support information is to be understood as simple generic information material.

It is understood that the image accompanying the product description may not be perfectly representative of its characteristics, but may differ in colour, size, accessory products shown in the figure.
Correct receipt of the order is confirmed by the Seller with an automatic reply via e-mail, sent to the e-mail address communicated by the customer at the time of registration. This confirmation message will contain an "order number", to be used in the event of any communication with the company. The message will contain all the data entered by the customer who undertakes to verify its correctness and to promptly communicate any corrections.

In case of non-acceptance of the order, the seller guarantees timely communication to the customer.

III. TERMS OF PAYMENT

All prices on the site are to be understood as prices to the public and, therefore, inclusive of VAT.
Prices may vary without prior notice and the only correct price is to be understood as the one indicated at the time of order confirmation.
On certain products, subject to price promotions, the seller reserves the right to accept orders by reducing the quantity, subject to notification and acceptance by the customer, failing which the order will be considered cancelled.

In cases of purchase of goods with "credit card" payment methods, together with the conclusion of the online transaction, the reference bank will authorize only the commitment of the amount relating to the purchase made. The amount relating to the delivered goods, even partially, will actually be charged to the customer's credit card only upon delivery of the ordered material to the courier.

The shipment of the goods takes place only after the acceptance of the order and the receipt of the credit.
In case of cancellation of the order, both by the customer and in case of non-acceptance of the same by the seller, the same will be canceled and the amount committed will be released (the release times depend exclusively on the banking system ). Once the transaction has been canceled, the seller cannot be held responsible for any damages deriving from the release of the amount committed by the banking system.

The seller reserves the right to ask the customer for additional documents proving ownership of the credit card. In the absence of sending the documentation, the seller reserves the right not to accept the order.
Transaction security is guaranteed by a data encryption system (SSL) and by direct, protected and certified connections.

Shipping and Transportation

DELIVERY TIME

  • Orders placed before 12:00 h will be delivered no later than 7 working days
    This does not include weekends or public holidays.
  • If you have purchased FOOD don't worry, the courier has guaranteed us optimal storage conditions and controlled temperatures , as well as a specific disinfection activity up to 2 times a week of all their environments.
  • Orders are delivered by the forwarding company GLS. Delivery is to be understood as roadside only
  • The difficulties to which couriers are subject also bind the sending of order tracking codes which will be sent as soon as possible.
  • At any time you can check the status of the shipment by entering
    the tracking number on the web page www.brt.it.

OUR SHIPMENTS

Our Shipments are carried out by the GLS courier, with whom we have an agreement based on various factors: the type of product, the weight, the volume and obviously the destination. These parameters are calculated automatically by our system and you can view them before payment in your cart in the " Calculate shipping " area or directly at the " Checkout ".

In general, in the absence of special offers, the product type parameter is calculated as follows:

  • For all categories with the exception of food, diapers and outdoor, shipping is free for orders over €80; if the amount of the Order is lower, the shipping costs start from €4.99.
  • For the "Food", "Diaper" and "Outdoor" categories, however, the calculation is more complex because it inserts the variable of weight (even a small product can be heavier than others) and volume (a product even if relatively light may be bulkier than others). Added to this is the packaging and dedicated handling.

The destination parameter is another important component, as it evaluates whether the entered location is present in "disadvantaged" areas and islands, thus evaluating the difficulties of access and the use of various means.

Shipments with destination on Islands or in "disadvantaged" areas is not never free .

The list of "disadvantaged" areas does not depend on Iperbimbo srl, but directly on the carrier based on the situations that characterize the Italian geographical areas in certain situations and in compliance with the existing Decree Laws. This listing it is not defined and it is not definable but dependent on continuous, unpredictable updates.

Shipping with payment on delivery, the "cash on delivery", is calculated as described above, with the addition of a further 8 €.

Shipments, being a paid service performed by an external company, cannot undergo price changes, unless previously agreed with the company itself.

Returns and Refunds

How to Make a Return

The return of purchased products is granted within the 14 days provided for by the rules on the right of withdrawal.

If you have received an incorrect product, the return will always be free and the product will be collected directly from the shipping address you provided when ordering.

If the return of the product depends on an incorrect purchase, color change, model replacement due to incompatibility or any other hypothesis not directly attributable to a shipping or processing error by Iperbimbo, the transport costs will be considered at your expense.

If you have received a defective product, we will provide warranty service by replacing the defective parts or, as the case may be, the entire product. If you still wish to proceed with the return of the item, renouncing warranty assistance, the return costs will be at your expense.

The collection costs depend on the weight and bulk volume of the product to be returned, distinguishable into 5 bands:

0-4kg  €8.90

The range of the product to be returned will be evaluated on a case-by-case basis at the time of the return request.

The customer can independently arrange for the return to be shipped; in this case, the return cost relating to the range to which the item belongs will not be deducted from the total refund.

It is not possible to make a return for the purchase of wooden products.

They will only be accepted returns of items that are new, complete with all their original packaging intact.

Right of withdrawal

Right of Withdrawal for Defect of Non-Conformity

The online customer who acts as a consumer is given the right to withdraw from the contract, as provided for by articles 64 – 67 of Legislative Decree no. 206/2005, known as the Consumer Code.
It should be noted that this right is reserved only for natural persons, i.e. for those private consumers who act for purposes unrelated to their profession. There is no right of withdrawal for legal and natural persons who act, with reference to the purchase contract, in a professional context.

Pursuant to and within the limits of art. 64 of the Consumer Code, the consumer has the right, within 10 working days of receiving the purchased products, to exercise the right of withdrawal, consisting in the possibility of returning the products received and obtaining a refund of the price paid, without penalty and without the need to specify the reason.

This right applies to all products purchased online on this site, with the exception of audiovisual or IT software products delivered sealed and subsequently opened by the customer.
The costs of returning the product are the responsibility of the consumer.

The right of withdrawal is lost if the returned product is not intact, due to the absence, for example, of integral elements of the product (accessories, cables, instruction manuals, etc.) or if the product has been damaged due to causes other than transport from the Seller to the consumer, not previously reported.
Without limiting the right of withdrawal, upon delivery of the product, the consumer, who has reason to believe that the product itself has been damaged during transport, must refuse delivery or accept it with express reserve.

Each collection of intact packages must be made by the customer by affixing the wording "INTACT PACKAGE, WITHDRAWAL SUBJECT TO CONTROL OF THE CONTENT" on the appropriate accompanying document (art. 1698 of the Civil Code). Any anomaly must then be communicated within eight days in the following ways:

Procedure for exercising the right of withdrawal

To exercise the right of withdrawal it is necessary to send, within 14 working days of receipt of the purchased product, a communication in which the intention to withdraw from the purchase contract is clearly expressed.
This communication must be sent, by registered letter with acknowledgment of receipt, to the following address:

The communication can be sent, within the same period, also by telegram (to the address indicated above),
The consumer will then have to arrange, using a courier of his choice, for the shipment of the product (if possible in the original packaging and, in any case, always carefully packed) and complete with all accessories, instruction manuals and everything originally contained.
The consumer must carry out this shipment within ten working days from the date on which he sent the communication of exercise of the right of withdrawal.

Important notes

Transport costs and responsibility for the goods during shipment, as required by law, are the responsibility of the consumer.
We therefore recommend that you insure the product with the chosen courier, taking care to pack the goods carefully, where possible placing the original packaging in an external box and, in any case, avoiding damaging the product with adhesive tapes, labels, etc. The product must be returned intact and complete with all its parts and accessories, including any warranties, instructions, licenses for use, cables, etc. In the event of transport damage occurring during the return, the Seller will notify the consumer of the damage within five working days of receiving the product, allowing the consumer to file a complaint with the courier used for transport. The damaged goods will be made available for return and the request for withdrawal will be canceled at the same time.
Except as provided below for the case of partial withdrawal, the Seller will reimburse, within 30 days from the moment in which the Seller became aware of the exercise of the right of withdrawal, the entire amount of the purchase and the costs of transport for delivery, by credit card reversal procedure or by bank transfer to the current account indicated by the consumer; the transport costs for returning the product remain the responsibility of the latter.

If the withdrawal is partial (i.e. it concerns only a part of the products delivered with a single delivery), the reimbursement of the shipping costs incurred by the consumer for the delivery of the products at the time of purchase is excluded.
With regard to purchases with collection from a Seller's point of sale, the right of withdrawal is not applicable as it is not a question of distance selling. Indeed, in that case, the consumer has only booked the product via the Internet, but has not yet purchased it and to do so he will have to go to the point of sale.
Order Cancellation Request
The purchase order can be canceled in its entirety if, at the time of the cancellation request, the shipment of the product is still being prepared and, in any case, if the amount has not yet been collected; in this case no cost will be charged to the customer.
If at the time of the request for cancellation of the purchase order the product has already been entrusted to the courier or, in any case, the amount has been collected, the consumer must exercise the right of withdrawal and send the goods back to the Seller.
To this end, it is necessary to follow the procedures indicated above for exercising the right of withdrawal.

Order tracking

Following the completion of your order, you will receive a summary email on the email used to complete the order containing all the information relating to your purchase.

The tracking code, or tracking code, in order to know the shipping status of your order will be sent automatically and directly by the courier to the email address you indicated when ordering.

The sending of the Tracking Code does not depend on the Iperbimbo website but on the courier in charge of the delivery.

Delivery time

Usually the products purchased on the Iperbimbo website are delivered within 48/72 hours , but due to the current health situation and the difficulties this entails, delivery times may be extended.

In any case, all shipments are guaranteed and insured regardless of possible delays.

To get an idea of ​​the status of your order you can refer to this legend:

  • Outstanding: the order is waiting for the payment to go through. If you have chosen quick payment methods (PayPal, Credit Card, Satispay) the status will quickly change to "In Process".
    If you have chosen the bank transfer, the processing times could be longer, even taking a few days, based on the processing times of the bank operator.
    In this case, don't worry, your order was successful anyway.
  • Under processing: Your order has been processed and will soon be prepared and shipped.
  • Completed: your order has been shipped, just wait for the courier's delivery times, bearing in mind that slight delays in this period are normal.
